Manufacturing company James Hardie were quoted saying White asbestos cannot cause cancer, after one of its employees contracted Mesothelioma.
73 year old Mr. Booth had been working at James Hardies for around 30 year after noticing a failure to his health.
An appeal was wholly rejected against the brake manufacturing giant, enabling Mr. Booth to receive the sum of £209,584,00. In a statement, he said that he was glad he could set an example, when legal teams were aware of other similar cases to that of his own.
Knowing that it would be a risk, the 73 year old continued to persevere and later hit back that he was disappointed in James Hardie for their lack of responsibilty in spite of losing the case.
Lawyers have recognised that the company need to admit fault, and are urging them to ensure that their workers are aware of asbestos risks.
