Company face penalty over death of new worker

Hanson Building Products have lost a new starter within 2 weeks of his employment, at the cost of a failure to provide correct supervision and a safe system of work.

Employee Peter Clarke was working at the plant in Coleshill, near Birmingham, when his head became trapped between some concrete blocks and a fixed metal gantry.

Peter was quality checking a 30-metre long conveyor with 27kg blocks, when the incident happened in April 2008.

Inspections were under way from the HSE, whereby there was a lack of common thought on Hanson’s behalf.

All other employee’s of Hanson had also failed to warn Clarke of the dangers that he would possibly face.

The company has been fined £280,000 as well as costs of £29,204 once they had pleaded guilty. The additional costs were at the breach of Section 2 of the Health and Safety at Work Act.

When in court, it was decided that Hanson were not only unable to ensure the safety and well-being of all its employees, but they had also failed to acknowledge a regular standard of operation and also in keeping its workers at bay of risks at all times.
